Terms of Service

By accessing or using FXSynapse AI ("the Platform"), operated at https://fxsynapseai.com by K2026174513 (Pty) Ltd (Registration Number 2026/174513/07), trading as FXSynapse AI ("the Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.

FXSynapse AI is an educational software tool that applies AI-based pattern recognition to user-uploaded chart images. The Platform identifies structural features (support/resistance levels, pattern zones, swing points, projection levels, invalidation points) and annotates them on the uploaded chart for study, journaling, backtesting and educational review.

The Platform is a software tool only. It is expressly not: a financial service, a signal provider, a copy-trading or social-trading service, an investment advisor, a broker, a dealer, an exchange, a money-transmission service, a custodian of funds, or an automated trading system. The Platform does not place, execute, recommend, or facilitate any trade.

Labels such as "key level", "projection", "invalidation point" and "confidence score" are structural descriptors of the annotated pattern, not directions to trade.

FXSynapse AI does NOT provide financial advice, investment recommendations, or trading signals.

All analysis generated by the Platform is for educational and informational purposes only. AI-generated output may contain errors, inaccuracies, or misinterpretations. You should never rely solely on this analysis for trading decisions.

Trading forex, commodities, indices, and CFDs carries significant risk. You can lose more than your initial deposit. Past performance does not guarantee future results. Always do your own research and consult a licensed financial advisor before trading.

You are solely responsible for your own trading decisions and any financial losses incurred. FXSynapse AI and its operators accept no liability for losses resulting from the use of this Platform.

FXSynapse AI is not a Financial Services Provider (FSP) and is not registered with the Financial Sector Conduct Authority (FSCA) of South Africa. We do not manage client funds, execute trades, or act as an intermediary to any financial product.

You must be at least 18 years old to use the Platform. You are responsible for maintaining the security of your account credentials. One account per person — shared or resold accounts will be terminated.

We reserve the right to suspend or terminate any account that violates these Terms or engages in abusive behaviour.

Account Deletion: You may request account deletion at any time via the in-app option (sidebar Profile menu → Delete Account) or the public page at https://fxsynapseai.com/account/delete. Requests are reviewed by our team and completed within 30 days. Deletion is irreversible. Some records (payments, tax invoices, fraud-prevention logs) may be retained where required by law.

5.1 Plans & Billing. The Platform offers a free tier and four paid subscription tiers (Scout, Starter, Pro, Max), plus one-time credit packs. Subscriptions are billed in advance, on a recurring monthly or annual cycle, on the date matching your initial purchase. Credit packs are one-time purchases and are credited to your account on payment confirmation.

5.2 Payment Processors.

• Card subscriptions — processed through our merchant of record, who acts as the seller on the invoice and handles payment authorisation, settlement, refund processing, tax compliance, and chargeback resolution. Card payments (Visa, Mastercard, Apple Pay, Google Pay) are routed through their secure checkout. The merchant of record's own terms apply to the payment transaction itself.
• NOWPayments — cryptocurrency settlements (USDT, BTC, ETH and others). NOWPayments generates a unique deposit address per order and credits your subscription or credit pack on blockchain confirmation.

By purchasing, you agree to the relevant processor's terms. Prices are displayed in South African Rand (ZAR) by default and may also be shown in USD/GBP/EUR using a reference exchange rate; the merchant of record bills in the supported local currency where available, otherwise in ZAR. The exact charge amount is shown on the checkout page before you confirm.

5.3 Auto-Renewal. Paid subscriptions auto-renew at the end of each billing cycle at the then-current rate, charged to the payment method saved with our merchant of record. You can disable auto-renewal at any time by cancelling the subscription — cancelled subscriptions remain active until the end of the period you have already paid for and do not renew thereafter.

5.4 How to Cancel. You may cancel a subscription at any time:

• Sign in to your FXSynapse AI account and use the cancellation option in your dashboard (Settings → Subscription); OR
• Email us at support@fxsynapseai.com with the subject line “Cancel subscription” and the email address on your account — we will action the cancellation within 1 business day.

Cancellation stops future renewals. Your access to paid features remains active until the end of the period you have already paid for. Cancellation alone is not a refund. If you also want a refund, see § 5.5.

5.5 Refund Policy.

7-Day Money-Back Guarantee (card subscriptions, first purchase only). If you are unsatisfied with your first paid subscription on FXSynapse AI, you may request a full refund within 7 days of the initial charge, provided you have used fewer than 5 chart scans during that period. To request a refund, email support@fxsynapseai.com with the subject line “Refund request”, the email address on your account, and the date of purchase. Approved refunds are processed by our payment processor and typically appear on your card within 5–10 business days.

Outside the 7-day window, or after the 5-scan threshold, refunds are not offered — the digital nature of the service means consumed scans cannot be reversed. Cancellation of future renewals (§ 5.4) is always available.

Renewals. Subscription renewals (the 2nd, 3rd, etc. billing cycles) are not eligible for the 7-day guarantee. To avoid being charged for the next cycle, cancel before the renewal date.

Credit packs. Credit packs are non-refundable once any credit has been consumed. If no credits have been used, contact us within 7 days of purchase for a full refund.

Cryptocurrency purchases (NOWPayments) are non-refundable. Blockchain transactions are irreversible by design. If a crypto subscription is cancelled within the 7-day window with fewer than 5 scans used, we will instead credit the unused subscription period to your account as a service credit equal in USD value, redeemable against any future plan or credit pack.

Failed delivery. If a technical issue prevents delivery of a purchased subscription or credit pack (e.g. webhook failure), email support@fxsynapseai.com within 7 days for activation or refund — this is independent of the policy above.

5.6 Pricing Changes. We reserve the right to change pricing at any time. Existing subscribers will be notified by email at least 14 days before any price increase takes effect on their next billing cycle. Continued use after the notice period constitutes acceptance of the new price; cancel before the next renewal if you do not agree.

5.7 Chargebacks. If you initiate a chargeback through your bank instead of contacting us first, we reserve the right to suspend your account pending resolution. We strongly prefer you reach out at support@fxsynapseai.com — in almost every case we can resolve the issue faster and without a chargeback fee landing on either side.

Platform Ownership: The FXSynapse AI platform — including its source code, algorithms, AI models, user interface design, branding, logos, email templates, marketing copy, and all visual assets — is the exclusive intellectual property of FXSynapse AI and its creators.

You may NOT:

• Copy, reproduce, or clone any part of the Platform's code, design, or functionality
• Reverse engineer, decompile, or attempt to extract the source code or AI prompts
• Resell, sublicense, or redistribute access to the Platform or its output
• Scrape, crawl, or use automated tools to extract data from the Platform
• Use the FXSynapse AI name, logo, or branding without written permission
• Create derivative works or competing products based on the Platform

Your Content: Charts you upload remain your property. By uploading, you grant FXSynapse AI a limited license to process and analyse your charts for the purpose of delivering the service. We do not claim ownership of your uploaded charts.

AI Output: Analysis results generated for your scans are licensed for your personal use only. You may not bulk export, resell, or redistribute AI-generated analysis as a commercial product or service.

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to the Platform, its servers, or other users' accounts
• Abuse the API or exceed rate limits intentionally
• Upload malicious files, scripts, or content designed to exploit the system
• Use the Platform to generate misleading content for fraud or market manipulation
• Share your account credentials or allow others to access your account
• Circumvent payment, scan limits, or any access controls

Violation of these terms may result in immediate account termination without refund.

The Platform is provided "as is" without warranty of any kind, express or implied. We do not guarantee uninterrupted access, accuracy of AI analysis, or fitness for any particular purpose.

We may modify, suspend, or discontinue any part of the Platform at any time without prior notice. Scheduled maintenance will be communicated where possible.

To the maximum extent permitted by law, FXSynapse AI and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

• Financial losses from trading based on AI analysis
• Loss of data, profits, or business opportunities
• Service interruptions or downtime
• Errors or inaccuracies in AI-generated output

Our total liability shall not exceed the amount you paid for the Platform in the 3 months preceding the claim.

FXSynapse AI offers an affiliate programme allowing users to earn commissions on referrals. Affiliate payouts are subject to verification and may be withheld if fraudulent activity is detected (e.g. self-referrals, fake signups, or manipulated traffic).

We reserve the right to modify commission rates, payout thresholds, or terminate the affiliate programme at any time.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from the use of the Platform shall be subject to the jurisdiction of the courts of South Africa.
